Abstract: The applicant seeks an order to deny the Respondent father access to the child. The Respondent seeks to have the Applicant held in contempt of court due to her breach of the Respondent's access rights as ordered by the Chambers judge.
Decision: The application of the father is dismissed. The Court held that the provisions of the previous order were couched in ambiguous terms which rendered it difficult to conclude that the mother intentionally breached the order. The application of the mother was granted based upon the lack of involvement of the father with the child and the court order psychological assessment which found that there was no attachment or bond between the child and the father. The issue of the father's access rights are to be determined at trial.
