MEMORANDUM In fairness to all concerned and for the sake of accuracy, I must correct a statement made in the final paragraph of my reasons for judgment in this matter filed on I August 9th 1993. A bound copy of the Department of Justice Act is, in fact, on hand in the Court. Although enacted in 1991, it is to be found in the Revised Statutes of the Northwest Territories 1988, so that it may be cited as "R.S.N.W.T. 1988 (3rd Supp.), c. 97". Previous to 1990, the annual statutes appeared separately from the Revised Statutes and not as a supplement to them. My search for the Act should have been directed to the Revised Statutes of 1988, even though the Act was not passed until 1991. By directing the Clerk to obtain documentation as to the designation of the k Attorney General of the Northwest Territories, ensuring due compliance with the

requirements of s. 18 of the Divorce Act, R.S.C 1985 (2nd Supp.), c.3 (enacted in 1986), my intention was to relieve counsel for the applicant of any need to do so, although she had indicated to the Court at the time of the hearing that she would. In this way, all doubts on that point, having regard to the language of s.18(1) of the Divorce Act, are I believe now resolved. Since this appears to be a matter of first impression under sections 18 and 19 of the Divorce Act in this Court, I trust that this note will make clear what was, to me at least, somewhat obscure; and thus help to expedite future applications of this kind.
