Abstract: Application for custody, maintenance and division of matrimonial property. Respondent seeking joint custody with a "shared parenting" arrangement, reduction of arrears of maintenance, and declaration that M. R. Holdings not be considered matrimonial property.
Decision: Held that it was not in the best interests of the children to be moved between the parents' homes. Custody granted to the Petitioner with generous access to the Respondent. Maintenance to be grossed up to $1,320.00 net per month. Income of Petitioner's fiance not considered. Maintenance arrears to be reduced from $14,500 to $10,000 due to change in income of the Respondent from illness. MR Holdings held to be a matrimonial asset as evidence indicated that the Petitioner was involved in the company. Matrimonial assets to be divided equally between the parties. Respondent allowed to deduct $181,500.00 premarital assets from the aggregate value of the matrimonial property.
