Abstract: The parties are engaged in a divorce action. Both parties are presently seeking an interim order for custody of the children pursuant to s. 16(2) of the Divorce Act. The wife is seeking sole interim custody. The husband is seeking an order directing shared custody on a rotating basis.
Decision: The wife's application is denied. The husband's application is denied as being unnecessary. The parents remain at law, joint guardians of their children. No order is made regarding interim custody or access. There is no evidence before the Court that is persuasive enough to disturb the present status quo.
