Abstract: The Applicant seeks an order in the nature of Certiorari quashing the suspension of the Applicant's licence under the Wildlife Act.
Decision: The application for an order in the nature of certiorari is granted. The duty of procedural fairness includes at least the right to know the alleged contraventions and the right to be heard, which will involve at least the opportunity to respond in writing and perhaps if a hearing is convened, the right to be heard in person or by counsel. The decision of the Deputy Superintendent Noble suspending the Applicant's licence is quashed. The applicant shall have costs on a party and party basis under column three.
