Abstract: The Applicant seeks an order setting out specific terms for access to the three and a half year old daughter of the relationship. The parties were not married but did cohabit from July 1990 until October 1991 and again from January to July 1992. The Respondent has custody of the child.
Decision: Specified access is granted, however not to the extent which the Applicant sought. The Applicant sought access that was tantamount to a joint custody arrangement. The evidence indicated that there was continuing animosity between the parties which would not be conducive to the arrangement suggested by the Applicant. Access is the right of the child and maximization of contact between the child and both parents should be the goal so long as it is consistent with the child's best interests.
