Abstract: Application for breach of contempt order. Determination of whether Defendant's conduct constituted watching and besetting. Behaviour was designed to heighten or escalate the tense atmosphere which existed. His behaviour brought discredit to the unions cause, and was a disservice to other members.
Decision: Bettger found in contempt of a court order. Sentence suspended for six months. Ordered to refrain from being within one kilometre of the mine site.
