Abstract: Application for leave to appeal a decision of the Development Appeal Board confirming a decision of the city to issue a development permit to the Comite Garderie Plein Solei. Issue was whether the Board had jurisdiction to render the decision. Concern about whether there was a reasonable apprehension of Bias. The Board Member had previously declared a conflict of interest but did not do so at the hearing of the application. The test applied to determine the bias issue was whether the facts of the case give rise to a reasonable apprehension which reasonably wellinformed persons could properly have of a biased appraisal and judgment of the issues to be determined.
Decision: Appeal dismissed.
