Abstract: Application to compel production of an audiotape of an interview of the child by a child abuse expert. The threshold test for disclosure of records is whether or not they are relevant. It is only after that review is there a consideration of issues of privilege and confidentiality. The court had reviewed the records and determined that there was noting relevant that was not already known or would its disclosure assist in the disposal of the litigation.
Decision: Application Denied with costs.
