Abstract: Application for costs in a successful certiorari proceeding. Costs are not awarded by way of damages. Solicitor and client costs are only ordered in rare and exceptional circumstance to mark the Court's disapproval of the conduct of a party. The judgment of the court had been that there was a flagrant breach of the Public Service Act and the court's obligation to respect the security of tenure of members of the public service provided in the Act. These findings were a valid ground to award solicitor client costs but were the only grounds on the material before the court.
