SUBJECT:     Criminal Law, Trafficking in “crack” Cocaine, Identity of Accused

Sentencing

 

SUMMARYDuring an undercover operation, the Accused sold $50.00 worth of crack cocaine to a police agent.  Accordingly he was convicted of one count of trafficking.

 

ISSUE:            The appropriate sentence.

 

RESULT:       Given the Accused’s favourable pre-sentence report and the exceptional circumstances, a community sentence of 2 years less a day was imposed.  This included an order for straight house arrest for the entire term.
