Summary:                   The separation occurred in Nova Scotia.  The husband moved to Ottawa.  The divorce was initiated in Ottawa.  The matrimonial home is located in Nova Scotia.  Jurisdictional issue solved at the last minute by agreement.  The wife was largely successful although there was mixed success on the issues.  Both parties raised issues which had little likelihood of success.

 

Issue:                          The effects of the following on an award of costs: last minute settlement after costs were incurred, raising issues that had little chance of success and late disclosure.
