DECISION:               January 25, 2011

 

SUMMARY:              Application to vary an order that provides a parenting plan and                                     request for Special Expenses.  The Applicant father requested a                                  change in parenting to one week on and one week off.  Evidence                           was this would not work for the mother who was a nurse on shift                              work.  Present order took that into consideration.  The Respondent                                     father disputes Special Expense receipts, although there were no                                arguments of the children’s activities.

 

ISSUE:                      Change in circumstance - review of payment of Special Expenses.

 

RESULT:                  Although there was two changes in circumstances (breakdown in                                 communication and non payment of Special Expenses) the Court                                 found it int the best interest to leave the parenting plan as is.  The                                  present order for Special Expenses was enforceable (Director                           Maintenance Enforcement advised) so it was ordered the                                              Respondent father pay all Special Expenses and the mother pay to                              him 43% of the expenses.  It was his duty to determine what had to                          be paid.
