13-821. Third-party beneficiary; creditor beneficiary; enforcement of contract.
__________________ (third party) may recover the benefits of the contract between __________________ and __________________ if the performance of __________________ (promisor's) obligation under the terms of the contract will satisfy a debt that __________________ (promisee) owed to __________________ (third party).
USE NOTE
This instruction should be used only when the third party seeking to enforce the contract is a "creditor" beneficiary of the contract obligee. In all other situations where a third party seeks to enforce a contract, UJI 13-820 should be used.
