TO: Mrs. Georgia L. Lusk Superintendent of Public Instruction Department of Education Santa Fe, New Mexico
{*19} I have your letter of January 20, 1945, wherein you request an opinion of this office concerning whether or not it would be violating any rule of the Interstate Commerce Commission to place the responsibility for the distribution of library materials and textbooks in this state under the New Mexico Educational Association.
I have been unable to find any rule or law which would involve the Interstate Commerce Commission upon such an arrangement being entered into. I have also contacted an employee of the Texas State Teachers' Association, who reports that they know of no ruling that you indicate in your letter, wherein the Interstate Commerce Commission has held that such an arrangement would be in conflict with any matters within the jurisdiction of such commission.
