TO: Regents of the Agricultural College, State College, New Mexico.

{*45} You have requested an opinion from this office as to whether or not the Regents of the Agricultural College of New Mexico have the power to sell a small tract of land now owned by the college to the federal government.

Section 130-1411 provides as follows:

"All of said institutions . . . and for the benefit of said institutions they shall have the power to buy and sell or lease or mortgage realty . . ."

This section of the statutes applies to several institutions named including the New Mexico College of Agriculture and Mechanic Arts. There is no question but what under the provisions of this section above quoted you do have full power and authority, by proper resolution and conveyance, to sell the tract of land in question to the federal government.
