TO: C. E. Worrell, Secretary Board of Examiners in Optometry, Clovis, New Mexico.
{*75} Under date of September 1, 1933, you ask for an opinion from this office as to whether or not osteopaths are permitted to practice optometry in this state.
Chapter 62, Laws of 1929, (Chapter 98, 1929 Code), provides that "It shall be unlawful for any person to engage in the practice of optometry in New Mexico unless he shall first have obtained a certificate of registration according to the provisions of this act." Obviously one licensed to practice osteopathy is not permitted to practice optometry unless optometry be included within the definition of osteopathy as defined in Chapter 117, Laws of 1933. It does not appear to me that optometry is included within the definition of osteopathy as stated in Chapter 117, Laws of 1933. It certainly is not mentioned specifically.
