{*87} This is in reply to your letter of October 6, 1933.
I do not think that the question has ever been passed upon by the Courts, but I am rather of the opinion that there is no appeal from peace proceedings in Justice of the Peace Courts. There is likely not much necessity for an appeal under the present practice. It is a special statutory proceeding and no provision is made for appeal. In my opinion, it is similar to the question discussed in State vs. Florez, 36 N.M. 80, 8 P (2d) 786.
I think you would be justified in refusing to grant an appeal in such cases.
