Opinion No. 16-1864
September 5, 1916
TO: Mrs. Laura Wilson Johnson, Palomas Hot Springs, N. M.,
Women not eligible to municipal offices.
OPINION
{*416} I have received your letter of the 2nd instant asking me if, under the laws of New Mexico, women are eligible to municipal offices, and I regret being compelled to say that I do not believe they are. By Section 2 of Article VII of the Constitution, it is provided that women possessing the qualifications of the male electors, prescribed in the first section of the same article, "shall be qualified to hold the office of county school superintendent, and shall also be eligible for election to office of school director or members of a board of education." The proper construction of this section is that it is exclusive of authority to hold any other offices than those enumerated.
