TO: Mr. Floyd Santistevan, Director, State Education Retirement, Santa Fe, New Mexico
In your letter of April 7, 1955 you ask whether school bus-owner drivers who have already been retired are entitled to the increased minimum retirement pay under the 1955 amendment to the school bus drivers' retirement act, being Chapter 51, Laws of 1955.
Under the authority of State ex rel Hudgins vs. Public Employees Retirement Board, 58 N.M. 543, 273 P. 2d 743, and Attorney General's Opinion No. 6019, we feel that such persons are entitled to the $ 100.00 minimum retirement commencing on the date the law goes into effect.
