REGINALD WAYNE KEHLER

 

­ WHEREAS:

 

(A)         A hearing was held by The Manitoba Securities Commission (“Commission”) on January 22, 2024, pursuant to a Notice of Hearing dated July 23, 2023, and Statement of Allegations of Staff dated July 23, 2023, to consider;

 

1)            whether it is in the public interest to order pursuant to subsection 59(1) of RESA that conditions be imposed on the registration of Reginald Wayne Kehler (Kehler) under RESA and/or his registration as a salesman under RESA be suspended or cancelled;

 

2)            whether the Manitoba Real Estate Association Inc. (MREA) should be ordered to pay to a person or persons an amount out of the Real Estate Reimbursement Fund (Fund) under subsection 65(2) of RESA pertaining to the actions of Kehler in connection with a trade or transaction in real estate;

 

3)            whether pursuant to subsection 59(1) of RESA it is in the public interest to order that Kehler pay the costs of the investigation and hearing;

 

4)            such further and other matters and the making of such further and other orders as the Commission may deem appropriate.

(B)         After reading the Notice of Hearing and Statement of Allegations of Staff, and upon hearing the evidence and submissions of Staff, and MREA not appearing although duly served, the Commission issued Reasons for Decision with respect to the Hearing held January 22, 2024;

 

(C)         The Commission is of the opinion that it is in the public interest to make this order.

 

IT IS ORDERED:

 

1.                        THAT pursuant to subsection 65(2) of RESA that MREA pay the sum of $10,394.00 to each of D.R. and P.R. from the Real Estate Reimbursement Fund.

 

2.                            THAT pursuant to subsection 60(1) Kehler pay costs in the sum of $12,075.00.

 

3.                            THAT pursuant to 59(1) Kehler’s registration be cancelled.
