PAUL RAYMOND HRANKOWSKI

WHEREAS:

(A) On May 5, 2005, The Manitoba Securities Commission ("Commission") pursuant to section 11(1) of The Real Estate Brokers Act ("Act") issued Order No. 2523 setting the date of the full hearing in the matter of Paul Raymond Hrankowski ("HRANKOWSKI") for May 19, 2005 at 9:00 a.m.;

(B) Furthermore pursuant to Order No. 2523, for the period of May 4, 2005 to May 19, 2005, the Commission lifted the interim suspension of HRANKOWSKI’s registration, as previously ordered pursuant to the without notice Order No. 2521, on conditions pertaining to the provision of disclosure by HRANKOWSKI to staff and weekly reporting by HRANKOWSKI to the Registrar under the Act;

(C) On May 19, 2005, pursuant to a Notice of Hearing issued May 3, 2005 and as set by Order No. 2523, the full hearing of the matter commenced before a panel of the Commission ("Hearing");

(D) Upon hearing the evidence as submitted on May 19, 2005, the Hearing having failed to conclude that day, upon being advised of HRANKOWSKI having failed to comply with the disclosure provisions of paragraph 2(a) of Order No. 2523, and upon hearing the submissions of counsel for staff of the Commission and of HRANKOWSKI appearing in person on his own behalf, the Commission is of the opinion that it is in the public interest to make this order.

IT IS ORDERED:

1. THAT, subject to confirmation of the availability of all panel members and of HRANKOWSKI, to be provided by HRANKOWSKI on or before May 20, 2005, the Hearing shall continue on Friday, June 3, 2005 at 9:00 a.m.

2. THAT, pursuant to subsection 11(1) of the Act, the interim suspension of the registration of HRANKOWSKI pursuant to Order No. 2521 and as lifted under conditions for the period of May 4, 2005 to May 19, 2005 pursuant to Order No. 2523, remains so lifted for the period of May 20, 2005 to June 3, 2005 inclusive, subject to the following conditions:

(a) On or before May 25, 2005, HRANKOWSKI provides to staff of the Commission disclosure consisting of the respondent’s witness list inclusive of addresses, a synopsis of the anticipated evidence of each of the respondent’s witnesses, and an outline of the respondent’s case, HRANKOWSKI having provided to staff on May 19, 2005 copies of the documents upon which he intends to rely;

(b) HRANKOWSKI to continue reporting to the Registrar on a weekly basis as to his activities as a registrant under the Act.

3. THAT, this matter be adjourned to Friday, June 3, 2005 at 9:00 a.m. at the offices of the Commission at 1130 - 405 Broadway, Winnipeg, Manitoba.
