WHEREAS:

 

(A)         On April 6, 2018, staff of The Manitoba Securities Commission (“Staff”) issued a Notice of Hearing and Statement of Allegations giving notice of its intention to hold a hearing to consider whether or not orders should be made under The Securities Act, R.S.M. 1988, c. S50 as amended (“Act”) with respect to Madison Street Limited Partnership, 5218838 Manitoba Ltd., and Brenda Andre (“Andre”);

 

(B)         Upon hearing submissions from Staff and submissions from counsel for the Respondents, The Manitoba Securities Commission (the “Commission”) is of the opinion that it is in the public interest to make this Order.

 

 

IT IS ORDERED:

 

1.                            THAT pursuant to subsection 154(2) of the Act, Andre pay $4,000.00 costs to the Commission to be paid by February 15, 2019;

 

2.                             THAT Andre provide to Staff by February 15, 2019, the following disclosure:

 

(i)            copies of all documents she intends to rely on as evidence at the hearing;

 

(ii)          a list of witnesses she intends to call to testify on her behalf at the hearing;

 

(iii)         (a)       the text of written statements made by witnesses             intended to be called;

 

(b)       in the absence of a written statement, tape or       transcription of an interview, a summary of anticipated        testimony of the witness.

 

(iv)         an outline of the proposed case of Andre.

 

 

 

3.                            THAT the hearing be adjourned to April 15 – 18, 2019 commencing at 9:00 a.m.
