                      ROBERTA MERLIN MCINTOSH, A.K.A. BERT MCINTOSH,

ROBERTA SIMS, ROBERTA BUTCHER AND ROBERTA MAYER

 

WHEREAS:

 

(A)         On February 26, 2015, the British Columbia Securities Commission (“BCSC”) issued a decision against Roberta Merlin McIntosh also known as Bert McIntosh, Roberta Sims, Roberta Butcher and Roberta Mayer (“BCSC Decision”);

 

(B)       On August 27, 2015, The Manitoba Securities Commission (“Commission”) issued a Notice of Hearing (“Notice”) giving notice of its intention to hold a hearing pursuant to section 148.4 of The Securities Act, R.S.M. 1988, c. S50 as amended (“Act”) to consider whether or not it was in the public interest to grant orders with respect to Roberta Merlin McIntosh also known as Bert McIntosh, Roberta Sims, Roberta Butcher and Roberta Mayer (“MCINTOSH”);

 

(C)       On October 14, 2015, this hearing matter came before a panel of the Commission;

 

(D)       Upon reviewing the documentary evidence including a response from the respondent and hearing the submissions of counsel for staff of the Commission, no one appearing for the respondent, and upon reviewing the Affidavit of Service, filed, and being satisfied as to service upon the respondent, the Commission is of the opinion that it is in the public interest to make this order.

 

IT IS ORDERED:

 

1.                            THAT, pursuant to section 148 of the Act, MCINTOSH cease trading in securities until the latest of February 26, 2025 and the date the Director of the Commission has received confirmation that the payments ordered under paragraphs 4 and 5 of the BCSC Decision have been made to the BCSC, except that MCINTOSH may trade securities for her own account through a registrant if she gives the registrant a copy of this order.

 

2.                            THAT, pursuant to section 148.3 of the Act, MCINTOSH resign any position she holds as a director or officer of any issuer and be prohibited from becoming or acting as a director or officer of any issuer until the latest of February 26, 2025, the date the Director of the Commission has received confirmation that the payments ordered under paragraphs 4 and 5 of the BCSC Decision have been made to the BCSC and the date upon which she successfully completes a course of studies satisfactory to the Director concerning the obligations of registrants and participants in the capital markets.
