ROBERT SYME
WHEREAS:
(A) A hearing was held by The Manitoba Securities Commission (the "Commission) in the matter of Robert Syme ("Syme) on February 12, 2007 pursuant to a Notice of Hearing and Statement of Allegations of Staff both dated June 26, 2006 to consider, inter alia, whether or not pursuant to subsection 148.2 of The Securities Act (Manitoba), that Syme be ordered to pay compensation for financial loss.
(B) After reading the Notice of Hearing and Statement of Allegations, Staff noting service having been effected upon Syme as confirmed by the Affidavit of Jason Roy sworn October 11, 2006, Syme having failed to appear at the hearing, and upon reviewing the evidence and submissions of Staff,
IT IS ORDERED THAT:
1. Pursuant to subsection 148.2(3) of the Act, Syme pay to Michael Bretecher the amount of $10,000.00;
2. Pursuant to subsection 148.2(3) of the Act, Syme pay to Diane Wasylnuk the amount of $5,000.00;
3. Pursuant to subsection 148.2(3) of the Act, Syme pay to Darren Payne the amount of $5,000.00.
