ENFORCEMENT SUMMARY

And in the Matter of Orange Properties (Man.) Ltd. o/a Orange Real Estate Services
On April 25, 2003, Judge Lerner of the Provincial Court of Manitoba accepted the guilty plea of Orange Properties (Man.) Ltd. o/a Orange Real Estate Services to a violation of section 14 of the Manitoba Regulation 57/88 (the "Regulation"), a regulation under The Real Estate Brokers Act ("REBA")
Orange Properties (Man.) Ltd. o/a Orange Real Estate Services failed to comply with the Regulation, and did thereby commit an offence under subsection 42(3) of REBA, by failing to file an Annual Trust Account Report within 4 months of its financial year end ending August 31, 2002. On February 4, 2002, Orange Properties (Man.) Ltd. o/a Orange Real Estate Services had previously been reprimanded for the late filing of the 2001 report.
The Court imposed a fine in this instance of $100.00. Costs and applicable surcharges were waived by Judge Lerner and the fine was ordered to be paid forthwith.
