The Toronto Police Services Board (the Police) received a request under the
Municipal Freedom of Information and Protection of Privacy Act (the Act) for access to records related to the requester’s detention in the holding cells at a court facility, including information regarding his transfers to and from a jail facility.
In response to the request, the Police denied access to all the responsive records pursuant to section 38(a) (discretion to refuse requester’s own information), in conjunction with the discretionary exemption in section 8(1)(a) (law enforcement); and pursuant to section 38(b) (invasion of privacy) in conjunction with the presumption in section 14(3)(b) of the
Act.
The requester, now the appellant, appealed the decision.
