Summary:

NATURE OF THE APPEAL: This is my final order disposing of the one remaining issue which wasinitially addressed in Interim Order P-1262. In that order, I directed theMinistry of the Attorney General (the Ministry) to provide me with writtenrepresentations addressing the application of section 49(b) of the Freedom of Information and Protection of Privacy Act (the Act )to Records 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 34, 45, 46, 47, theattachments to the April 22, 1994 letter in Record 48 and Records 50 and 51 fromthe January 31, 1996 Ministry decision letter, as well as Record 66 from theMinistry's May 10, 1996 decision letter, which were at issue in that appeal. I have received the representations of the Ministry and have carefullyconsidered them. In the circumstances of this appeal, I am satisfied that theMinistry has exercised its discretion in accordance with established legalprinciples. Therefore, it is my view that the Ministry's decision should not bedisturbed on appeal. ORDER: I uphold the Ministry's decision to deny access to Records 21, 22, 23, 24,25, 26, 27, 28, 29, 30, 31, 32, 34, 45, 46, 47, the attachments to the April 22,1994 letter in Record 48 and Records 50 and 51 from the January 31, 1996Ministry decision letter, as well as Record 66 from the Ministry's May 10, 1996decision letter. NATURE OF THE APPEAL:

 

This is my final order disposing of the one remaining issue which was initially addressed in Interim Order P-1262.  In that order, I directed the Ministry of the Attorney General (the Ministry) to provide me with written representations addressing the application of section 49(b) of the Freedom of Information and Protection of Privacy Act (the Act) to Records 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 34, 45, 46, 47, the attachments to the April 22, 1994 letter in Record 48 and Records 50 and 51 from the January 31, 1996 Ministry decision letter, as well as Record 66 from the Ministry’s May 10, 1996 decision letter, which were at issue in that appeal.

 

I have received the representations of the Ministry and have carefully considered them.  In the circumstances of this appeal, I am satisfied that the Ministry has exercised its discretion in accordance with established legal principles.  Therefore, it is my view that the Ministry’s decision should not be disturbed on appeal.

 

ORDER:

 

I uphold the Ministry’s decision to deny access to Records 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 34, 45, 46, 47, the attachments to the April 22, 1994 letter in Record 48 and Records 50 and 51 from the January 31, 1996 Ministry decision letter, as well as Record 66 from the Ministry’s May 10, 1996 decision letter.
