Summary:

Order disposing of the one remaining issue which was initially addressed in Interim Order P-1201. In that order, I directed the Ministry of Natural Resources (the Ministry) to provide written representations on the factors it considered in exercising its discretion to disclose the records at issue to the requester pursuant to section 49(b) of the Freedom of Information and Protection of Privacy Act (the Act ). I have received the representations of the Ministry and have carefully considered them. In the circumstances of this appeal, I am satisfied that the Ministry has exercised its discretion in accordance with established legal principles. Therefore, it is my view that the Ministry's decision should not be disturbed on appeal. ORDER: I uphold the decision of the Ministry to disclose the records. This is my Final Order disposing of the one remaining issue which was initially addressed in Interim Order P-1201.  In that order, I directed the Ministry of Natural Resources (the Ministry) to provide written representations on the factors it considered in exercising its discretion to disclose the records at issue to the requester pursuant to section 49(b) of the Freedom of Information and Protection of Privacy Act (the Act).

 

I have received the representations of the Ministry and have carefully considered them.  In the circumstances of this appeal, I am satisfied that the Ministry has exercised its discretion in accordance with established legal principles.  Therefore, it is my view that the Ministry’s decision should not be disturbed on appeal.

 

ORDER:
