Order disposing of the outstanding issues referred to in Interim Order M-352, dated July 14, 1994. In Order M-352, I ordered the Municipality of Metropolitan Toronto (the Municipality) to determine whether it would exercise its discretion to deny access to the undisclosed portions of several records under section 38(b) of the Act . I also ordered the Municipality, in the event that it decided to deny access, to provide me with representations indicating what factors it took into account in reaching that decision. The Municipality has provided me with a copy of its decision letter, in which it exercises its discretion to deny access under section 38(b). I have also received the Municipality's representations with respect to its exercise of discretion. In reviewing the exercise of discretion, I find nothing improper, and would not alter it on appeal. This is my Final Order disposing of the outstanding issues referred to in Interim Order M‑352, dated July 14, 1994.
In Order M-352, I ordered the Municipality of Metropolitan Toronto (the Municipality) to determine whether it would exercise its discretion to deny access to the undisclosed portions of several records under section 38(b) of the Act. I also ordered the Municipality, in the event that it decided to deny access, to provide me with representations indicating what factors it took into account in reaching that decision.
