MISCONDUCT:  Ont. Reg. 991, ss. 14(1) and 14(13).

 

PARTICULARS OF THE COMPLAINT:

 

It was alleged that Anita Saraswati Jaipershad assisted Karrunawatti (Kay) Persaud in failing to follow underwriting procedures as set out by an insurer and the Servicing Carrier by not disclosing U.S. exposure on applications of insurance and by issuing false MCS90 forms to drivers to allow them to transport into the United States.

 

DISCIPLINE COMMITTEE’S DISPOSITION:

 

This matter was held concurrently with the hearing of Karrunawatti (Kay) Persaud, and the same evidence was presented with respect to both brokers. The Discipline Committee found that there was sufficient evidence in support of the plea of guilty by Anita Saraswati Jaipershad to the allegations contained in paragraphs 1 through to 7 under the Particulars of the Complaint of the Direction and finds that, Anita Saraswati Jaipershad is guilty of misconduct as alleged therein.  The Discipline Committee therefore ordered:

 

a)        That the Certificate of Registration of Anita Saraswati Jaipershad be suspended for 90 days commencing from the date of this Order.

 

b)        That after the 90 day suspension the Certificate of Registration of Anita Saraswati Jaipershad will be revoked; and in order for the license to be reinstated Anita Saraswati Jaipershad must demonstrate that she has taken and passed the RIB Act, Regulations and By-Laws Equivalency Exam.
