REGARDING the Insurance Act, R.S.O. 1990, c. I.8, as amended, in particular sections 441.3
AND REGARDING Lee Health Clinic, Inc.
ORDER TO IMPOSE ADMINISTRATIVE MONETARY PENALTY
On September 17, 2018, the Superintendent of Financial Services (the “Superintendent”) issued a Notice of Proposal to impose the following administrative monetary penalties on Lee Health Clinic, Inc.:
- $1,000 for storing clinic files off site;
- $2,500 for failing to take reasonable steps to verify the identity of clients;
- $1,000 for failing to establish policies and procedures;
- $2,500 for failing to have signed OCF-21 forms on file;
- $1,000 for failing to keep the HCAI Rostered Health Professionals List updated.
On October 4, 2018, Lee Health Clinic, Inc. requested a hearing with the Financial Services Tribunal.
The Superintendent and Lee Health Clinic, Inc. entered into minutes of settlement to settle this matter on a full and final basis.
On February 7, 2019, Lee Health Clinic, Inc. withdrew its request for hearing at the Financial Services Tribunal.
ORDER
An Administrative Monetary Penalty in the amount of $3,000 is imposed on Lee Health Clinic, Inc.
TAKE NOTICE THAT Lee Health Clinic Inc. will be receiving shortly an invoice from Ontario Shared Services, a part of the Ministry of Government and Consumer Services, with information as to where and how to make the payment. Lee Health Clinic Inc. must pay the Administrative Monetary Penalty no later than 6 months after the date of the invoice.
If Lee Health Clinic Inc. fails to pay the Administrative Monetary Penalty in accordance with the terms of this Order, the Superintendent may file the Order with the Superior Court of Justice and the Order may be enforced as if it were an order of the Court. An Administrative Monetary Penalty that is not paid in accordance with the terms of an order imposing the penalty is a debt due to the Crown and is enforceable as such.
