[1]        In an elaborate judgment, Nadon J. concluded that the investigator appointed by the chairperson of the National Parole Board pursuant to s. 152(4) of the Corrections and Conditional Release Act, S.C. 1992, c. 20 ("the Act") was not appointed to investigate and report on matters relating to the Commission's operations:


152.(4) The Chairperson may appoint a person or persons to investigate and report on any matter relating to the operations of the Board, and sections 7 to 13 of the Inquiries Act apply in respect of such investigations, with such modifications as the circumstances require, as if the references to "commissioners" in those sections were references to the person or persons so appointed.

152.(4) Le président peut nommer une ou plusieurs personnes chargées d'enquêter et de faire rapport sur toute question portant sur les activités de la Commission; les articles 7 à 13 de la Loi sur les enquêtes s'appliquent à ces personnes, avec les adaptations nécessaires, comme si les renvois aux commissaires étaient des renvois aux personnes que nomme le président.

[2]        After a careful review of the investigator's report and the instructions given to him, he came to the conclusion that the investigator had actually been instructed to investigate and report on the actions and conduct of the respondent, and that was in fact what the investigator did: hence his conclusion that the investigator did not have jurisdiction to do this (see decision, appeal book, p. 34, para. 40).

[3]        Nadon J. also recognized that the chairperson of the Commission could under s. 152(4) of the Act direct the person appointed [TRANSLATION] "to investigate allegations of interference made in respect of the National Parole Board, including the allegations made by the respondent" (see decision, appeal book, p. 32, para. 37).


[4]        We agree with the conclusions of Nadon J. The appeal will accordingly be dismissed with costs.
