REASONS FOR JUDGMENT OF THE COURT

[1]                 We are satisfied that the Board of Referees had misdirected itself in its consideration of the decision of Justice Boissonneault in respect of his award of damages to the Respondent for wrongful dismissal. It was open to Umpire Goulard, therefore, to make the decision he made.


[2]                 We have not been persuaded, despite the able argument of Mr. Edwards, that there was any error in Umpire Goulard's decision that would warrant interference by this Court.

[3]                 The application will be dismissed with costs to the Respondent fixed at $8,000.00 inclusive of disbursements and G.S.T.
