[1]         On November 24, 2000 the respondent Dicom Express Inc., through its counsel Normand Laurendeau, filed its bill of costs pursuant to the Court's judgment on June 14, 2000 and asked that the assessment of costs proceed without a personal appearance by the parties.

[2]         On December 19, 2000 we caused a copy of the bill of costs to be sent to Ernest Guiste, counsel for the appellant, inviting him to submit his comments in opposition to the said bill by January 12, 2001 at the latest. As no representations have been made, we are prepared to assess the respondent's costs.


[3]         In view of the foregoing and of the guidelines set out in s. 400(3) of the Federal Court Rules, fees in the amount of $1,400 are awarded for the services rendered under items 19 (6 units), 22a ($400) and 26 (4 units). The disbursements will be awarded as submitted.

[4]         The respondent's costs are accordingly assessed and allowed in the amounts of $1,400 for fees and $22.25 for disbursements. A certificate will be issued in the amount of $1,422.25.
