[1] We are all of the view that in the peculiar circumstances of this case the learned Umpire could have come to the conclusion that he did in reviewing the Board of Referees decision, we therefore will dismiss this application for Judicial Review.
[2] In other words the matter will be referred back to the Board of Referees for a hearing on the merits of this appeal as directed by the Umpire.
