REASONS FOR JUDGMENT
(Delivered from the Bench at Toronto, Ontario
Monday, March 30, 1998)
DESJARDINS, J.A.
[1] We have concluded that there is no basis for interfering with the decision of the Motions Judge dismissing the appellant's action.
[2] It was open to him, in the exercise of his discretion, to find that the appellant had not furnished proper particulars with respect to paragraphs 9, 11 and 12 of her Statement of Claim following an order of the Trial Division and that, in the absence of those particulars as ordered, the remaining allegations in her Statement of Claim were frivolous and constituted an abuse of the process of the Court.
[3] This appeal will therefore be dismissed.
