[1] This assessment of costs is further to the judgment on June 5, 2001, dismissing the appeal, with costs to the respondent.
[2] Counsel for the respondent filed his bill of costs on August 23, 2002, accompanied by a request for a decision without a personal appearance by the parties.
[3] On September 6, 2002, a copy of the respondent's bill of costs was sent to the appellant for his written comments, which have not been provided to date. In view of the foregoing, I am ready to assess the costs to the respondent.
[4] The fees requested are awarded, except for the request under item 26 for assessment of costs. As the assessment of costs was not challenged, 2 units are awarded.
[5] The disbursements are awarded as requested.
[6] The respondent's costs are accordingly assessed and allowed in the amount of $1,999.40. A certificate is issued for that amount.
