[1]      We are all of the view that this appeal must fail.

[2]      Assuming without deciding that the appellant never received the decision of the Minister of Indian and Northern Affairs dated December 10, 1980, sent to him by registered mail, and that he never became a "person affected thereby" as described in section 47 of the Indian Act1, there is no question that the appellant received the other decision of the Minister dated November 2, 1993, refusing to reopen his case. Yet it took the appellant one year before he started proceedings before the Trial Division.

     Section 47 of the Indian Act reads:


A decision of the Minister made in the exercise of the jurisdiction or authority conferred on him by section 42, 43 or 46 may, within two months from the date thereof, be appealed by any person affected thereby to the Federal Court, if the amount is controversy in the appeal exceeds five hundred dollars or if the Minister consents to an appeal. R.S., c. I-6, s. 47; R.S., c. 10(2nd Supp.), ss. 64, 65.

Une décision rendue par le ministre dans l'exercice de la compétence que lui confère l'article 42, 43 ou 46 peut être portée en appel devant la Cour fédérale dans les deux mois de cette décision, par toute personne y intéressée, si la somme en litige dans l'appel dépasse cinq cents dollars ou si le ministre y consent. S.R., ch. I-6, art. 47; S.R., ch. 10(2e suppl.), art. 64 et 65.

[3]      The Motion Judge made no error in refusing the appellant an extension of time to file his appeal and in finding that there was no special circumstances warranting such an extension.

[4]      This appeal will be dismissed with costs to both respondents.
