[1] This is a motion to stay proceedings before the Canada Industrial Relations Board following the dismissal of a motion of challenge submitted by the applicants. The applicants challenged this decision of the Board by means of judicial review and asked that the proceedings before the Board be stayed until the Court of Appeal has ruled on the merits of their application.
[2] Each of the arguments raised by the applicants against the impugned decision can be made if necessary following the Board"s final decision in this matter. It is clearly desirable that the proceedings before the Board should not be interrupted unless there are very special circumstances.1 No such circumstance was established. In particular, a brief review of the case2 does not allow the Court to conclude that the Board"s actions indicate "a mind so closed that any submissions would be futile".3
[3] The motion for a stay will accordingly be dismissed.
