REASONS FOR JUDGMENT OF THE COURT

(Delivered from the Bench at Toronto, Ontario

on Tuesday, May 7, 2002)

LINDEN J.A.

[1]                 As the Tax Court Judge made no error, this appeal must be dismissed.

[2]                 Even if the evidence of the applicant that he telephoned the Court to notify it of his change of address is accepted, he failed to comply with Rule 5(3). This rule requires notification forthwith in writing of any change of address. Consequently, if he failed to receive the notice, it was as a consequence of his own non-compliance with Rule 5(3).

[3]                 No costs.
