[1]                 On March 14, 2001 Dominique Guimond, counsel for the defendant, filed a memorandum asking that the costs be assessed pursuant to a Court of Appeal judgment rendered on June 20, 2000 dismissing the application for judicial review with costs.

[2]                 In a letter accompanying his memorandum Mr. Guimond asked that the taxation proceed without a hearing and on the basis of the affidavit and evidence submitted. On March 22, 2001 a letter was sent to Jean Crête, the plaintiff's representative, inviting him to file his representations by April 13, 2001. As no representations have been received to date, the defendant's costs are accordingly assessed.


[3]                 For fees Mr. Guimond claimed $700 under item 19, $515 under item 22 and $600 under item 26. As there is nothing in the record that would enable me to allow the maximum number of units, the claim under item 19 is reduced to $500. The claim for $515 under item 22 is allowed and the claim for $600 under item 26 is reduced to $200 as this assessment was not opposed in any way.

[4]                 The claim for disbursements in the amount of $434.14, supported by Christine Mance's affidavit, is allowed.

[5]                 The defendant's costs are assessed and allowed in the amount of $1,215.00 for fees and $434.14 for disbursements. A certificate is issued in the amount of $1,649.14.
