                                            ASSESSMENT OF COSTS - REASONS

FRANÇOIS PILON

Assessment Officer

[1]         On November 30, 2000 the defendant, represented by Roger Roy, filed his bill of costs pursuant to the Court's judgment on June 8, 2000 and asked that it be assessed without a personal appearance by the parties.

[2]         On December 19, 2000 we caused a copy of the bill of costs to be sent to Vicky Lapierre, acting for the plaintiff, inviting her to file her written submissions by January 19, 2001 at the latest. To date no submissions have been received from her.

[3]         In view of the foregoing and of the guidelines set out in s. 400(3) of the Federal Court Rules, fees in the amount of $1,650 are awarded for the services rendered under items 2 (5 units), 13 (3 units), 14 ($350), 25 (1 unit) and 26 (4 units).

[4]         Disbursements in the amount of $347.77 for photocopying and service costs will be awarded as submitted.

[5]         The defendant's costs are therefore assessed and allowed in the amounts of $1,650 for fees and $347.77 for disbursements. A certificate will be issued for the amount of $1,997.77.
