The applicant has not persuaded us that the learned Umpire, McGillis J., erred in her decision of November 7, 1995, when she concluded that "the extensive factual findings made by the Board of Referees were reasonably open to it on the evidence", and that "there was ample evidence in the record to support the conclusions that Mr. McGetchie was working a full working week and that he knowingly made false or misleading statements".
The section 28 application will be dismissed.
