[1]        Marie Lebbad is appealing an order by a trial judge which dismissed her application for an extension of time in order to challenge an order by the prothonotary, which had struck out her amended statement of claim.


[2]        This appeal is inadmissible. The appellant does not have the capacity to be a party to an action (art. 56 of the Code of Civil Procedure), since she is the subject of a protective regime by the Public Curator.

[3]        What is more, her action, which was belated, cannot succeed.

[4]        The appellant asked the Federal Court to restore her old age security benefits by deducting them from the protective regime which she claimed she obtained illegally.

[5]        This protective regime is governed by the Public Curator Act, R.S.Q. c. C-81, an Act adopted by the Quebec National Assembly. The public curator is not a federal board, commission or other tribunal within the meaning of the Federal Court Act, which defines "federal board, commission or other tribunal" in s. 2(1):

2.(1) Definitions - In this Act,

"federal board, commission or other tribunal" means any body or any person or persons having, exercising or purporting to exercise jurisdiction or powers conferred by or under an Act of Parliament or by or under an order made pursuant to a prerogative of the Crown, other than any such body constituted or established by or under a law of a province or any such person or persons appointed under or in accordance with a law of a province or under section 96 of the Constitution Act, 1867.

« office fédéral » Conseil, bureau, commission ou autre organisme, ou personne ou groupe de personnes, ayant, exerçant ou censé exercer une compétence ou des pouvoirs prévus par une loi fédérale ou par une ordonnance prise en vertu d'une prérogative royale, à l'exclusion d'un organisme constitué sous le régime d'une loi provinciale ou d'une personne ou d'un groupe de personnes nommées aux termes d'une loi provinciale ou de l'article 96 de la Loi constitutionnelle de 1867.

[6]        Section 18(1) of the Federal Court Act states that the Federal Court Trial Division's jurisdiction extends to "any federal board, commission or other tribunal". As the Public Curator is not a "federal board, commission or other tribunal" it is thus outside the jurisdiction of this Court.

[7]        The appeal should be dismissed without costs.
