REASONS FOR JUDGMENT OF THE COURT

[1] This appeal is from an order of Mr. Justice Phelan dated May 9, 2005 (2005 FC 647) in which he dismissed the appellant's application pursuant to s. 44 of the Access to Information Act R.S.C. 1985, c. A-1 (the Act).
[2] We are satisfied that the Federal Court Judge made no error in the formulation of the application of the applicable legal principles and made no palpable or overriding error in reaching his decision.
[3] Accordingly, the appeal will be dismissed with costs.
