Date: 20070511

Docket: IMM-3586-06

Citation: 2007 FC 507

Toronto, Ontario, May 11, 2007

PRESENT:     THE CHIEF JUSTICE

BETWEEN:

ZHOU WEI WANG

Applicant

and

THE MINISTER OF CITIZENSHIP AND IMMIGRATION

Respondent

REASONS FOR ORDER AND ORDER

[1]               The applicant’s refugee claim is based on his fear of persecution by reason of his membership in a Christian underground church in China. The Refugee Protection Division determined that the applicant’s testimony was not credible and supported its decision with several detailed findings of fact.

[2]               Four of the credibility issues are more significant than the others. The record discloses confusion concerning the time period when the applicant first met the preacher responsible for his conversion. Also, there was an important inconsistency between the personal information form and the oral testimony concerning the applicant’s role in guarding the place of worship prior to the intrusion by the police. There was no reviewable error in the tribunal’s assessment of the applicant’s knowledge of Christianity. It was open to the tribunal to assess the evidentiary value of the Canadian pastor’s letter of support as it did.

[3]               The applicant has not persuaded me that the tribunal’s negative findings of fact, either individually or cumulatively, were patently unreasonable. In the circumstances, the Court’s intervention is not warranted.

[4]               The application for judicial review will be dismissed. The proceeding raises no serious question of general importance.

ORDER

THIS COURT ORDERS that this application for judicial review is dismissed.

“Allan Lutfy”

Chief Justice
