BETWEEN:

     DONALD STANLEY BAXTER,

     Plaintiff,

     - and -

     HER MAJESTY THE QUEEN,

     Defendant.

     REASONS FOR ORDER

(Delivered from the Bench, at Winnipeg,

Manitoba, on Monday, July 31, 2000)

ROTHSTEIN, J. (ex officio)

[1]      The defendant moves to strike the statement of claim as being vexatious and scandalous.

[2]      The statement of claim alleges that the Queen has refused to act according to the Constitution and her oath, that Parliament and the Government as well as the provincial legislatures and governments are corrupt, perverted, and incompetent and that this has led to situations that produce or tend to produce feelings of hostility and ill-will between different classes of persons in Canada.

[3]      The statement of claim asks the Queen to dismiss Parliament and the Governor General, the provincial legislatures and lieutenant governors and for other ancillary relief.

[4]      The plaintiff advised the Court that he was not asking for a court order against the Queen.

[5]      The plaintiff"s complaints are of a political and not a legal nature. His remedy lies in the democratic process.

[6]      The statement of claim is struck out. The defendant is entitled to costs.
