[1]         On March 24, 2000, the Respondent filed his bill of costs and requested an appointment for assessment of costs with respect to the judgment in this case dated January 6, 2000. On May 15, Mr. Stephen Fineberg, counsel for the Applicant, and Mr. Eric Lafrenière, representing the Respondent, appeared before me for the taxation of the Respondent's bill of costs amounting to $1,800.

[3]         At the start, Mr. Fineberg raised the financial situation of the Applicant to contest this proceeding. Since the issue of costs has already been determined by the Court, I explained to counsel that my role, as an assessment officer, was to fix the amount due to the Respondent.

[4]         Subsequently, counsel for the Applicant objected to the maximum number of units requested by the Respondent under item 2. After hearing representations of both parties, I allow 5 units for that claim. I agree with Mr. Fineberg that the maximum number of units is to be reserved for the more complex files. The other items of the Respondent's bill of costs are allowed as is.

[5]         The Respondent's costs in this matter are taxed at $1,600. A certificate is issued for that amount.
