GILES, A.S.P.:

     Before an extension of time can be granted within which to file an Applicant's Record, the applicant must show, inter alia, facts tending to excuse the delay and in addition evidence of the existence of an arguable case for leave.

     The only fact presented as an excuse for delay, is that the applicant was awaiting Legal Aid. It is frequently held by this Court that awaiting Legal Aid does not excuse a delay. In addition, no attempt was made to show the existence of an arguable case for leave.

ORDER

     The application for an extension of time is dismissed for the foregoing reasons.
